These Terms of Service ("Terms") are an agreement between you and Tropic Endeavors, LLC ("VowSpace," "we," "us," or "our") governing your access to and use of VowSpace, ourvowspace.com, EventPix, eventpix.photo, and any related websites, applications, domains, features, tools, or services we provide (collectively, the "Service").

Please also review our Privacy Policy, which explains how we collect, use, and protect personal information.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and that organization.

2. Eligibility

You must be at least eighteen (18) years old and capable of forming a legally binding contract to use the Service. By using the Service, you represent and warrant that you meet this requirement.

3. Description of Service

VowSpace is a wedding planning platform that provides tools to help couples organize wedding details, manage guest lists and RSVPs, track budgets, coordinate tasks, and share information with guests and vendors.

EventPix is a photo-sharing feature that allows wedding guests to upload and view photos through a unique upload link or QR code, including via the eventpix.photo domain.

The Service is provided for organizational and convenience purposes only.

4. Changes to These Terms

We may update these Terms from time to time. If we do, we will update the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

5. User Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You agree to notify us promptly of any unauthorized use or suspected security breach.

6. User Content

You retain ownership of any content you submit, upload, transmit, or otherwise make available through the Service, including wedding details, guest information, photos, and other materials ("User Content").

You are solely responsible for your User Content and represent that you have all rights necessary to submit it and grant the rights described in these Terms.

Guest information, RSVP responses, and related data are provided by users or guests. We do not verify the accuracy, completeness, or timeliness of such information and are not responsible for errors, omissions, or misunderstandings arising from guest-provided data.

7. Our License to User Content

By submitting User Content, you grant VowSpace a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, cache, reproduce, process, display, perform, distribute, and use your User Content as reasonably necessary to:

  • operate and provide the Service,
  • maintain, secure, and improve the Service,
  • troubleshoot, support, and enforce these Terms.

This license continues until your User Content is deleted, subject to reasonable backup, archival, or legal retention requirements.

8. AI Training and Machine Learning

You acknowledge and agree that VowSpace may use certain User Content to develop, train, fine-tune, evaluate, and improve automated systems, including machine-learning and AI technologies, for purposes such as feature improvement, organization, recommendations, fraud or abuse detection, personalization, photo handling, and customer support tooling.

Personal information will be handled in accordance with our Privacy Policy and applicable law.

9. EventPix and Photo Sharing Disclaimer

EventPix and eventpix.photo are provided as a convenience for collecting and sharing event photos.

We do not guarantee that uploaded photos will be preserved indefinitely or remain available without interruption. Photos may be lost, corrupted, deleted, or become unavailable due to technical issues, maintenance, service changes, third-party providers, or circumstances beyond our control.

Guests upload photos at their own discretion and risk. Users are encouraged to download and back up important photos promptly. VowSpace is not a photo backup or archival service.

10. Acceptable Use

You agree not to:

  • use the Service for unlawful purposes;
  • interfere with or disrupt the Service or its systems;
  • attempt unauthorized access to any portion of the Service;
  • scrape, crawl, or harvest data without written permission;
  • upload malware or harmful code;
  • abuse, harass, or harm others through the Service;
  • infringe the rights of others.

We may investigate and take action for suspected violations.

11. Third-Party Services and Links

The Service may integrate with or link to third-party websites, services, tools, or content. We do not control third parties and are not responsible for their content, policies, availability, or actions. Your use of third-party services is at your own risk and subject to their terms.

12. No Professional Advice

VowSpace provides organizational tools only and does not offer professional wedding planning, financial, legal, medical, or vendor advice. Any templates, suggestions, budgets, timelines, or guidance are informational only.

You are solely responsible for your wedding decisions, arrangements, contracts, deadlines, and outcomes.

We do not guarantee the success, timing, completion, or outcome of any wedding, event, or related activity. Use of the Service does not ensure that tasks will be completed, deadlines met, vendors secured, guests respond, or events occur as planned.

13. Intellectual Property

The Service (excluding User Content), including software, design, branding, and trademarks, is owned by or licensed to us and protected by applicable laws.

Trademarks include, without limitation: VowSpace, EventPix, ourvowspace.com, eventpix.photo, and Tropic Endeavors, LLC. You may not use our marks without prior written permission.

14. Copyright and DMCA Policy

We respect intellectual property rights and comply with the Digital Millennium Copyright Act ("DMCA").

DMCA notices or counter-notices must include all information required under 17 U.S.C. §512 and should be sent to:

We may remove content and terminate repeat infringers where appropriate.

15. Suspension, Termination, and Content Removal

We may suspend or terminate access to the Service or remove User Content at any time if we believe these Terms are violated, risk is created, or misuse occurs.

You may stop using the Service at any time. Account deletion and data handling are governed by our Privacy Policy.

16. Payments, Subscriptions, and Future Paid Features

Certain features may become paid in the future. If you purchase a paid feature or subscription, additional terms may apply at checkout.

Unless otherwise stated:

  • payments are non-refundable to the extent permitted by law;
  • prices may change with notice;
  • subscriptions may auto-renew unless canceled before renewal;
  • you are responsible for applicable taxes.

Third-party payment processors may be used and their terms may apply.

17. Electronic Communications and Text Messaging

By using the Service, you consent to receive service-related communications electronically (email, in-app notices, or similar). If SMS features are offered, message and data rates may apply, delivery is not guaranteed, and opt-out instructions will be provided at enrollment. Operational messages may be required for certain features.

18. Disclaimers of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DATA WILL NOT BE LOST OR CORRUPTED.

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VOWSPACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR EMOTIONAL DAMAGES, INCLUDING LOSS OF DATA, WEDDING INFORMATION, PHOTOS, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION.

VOWSPACE'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: THE AMOUNT YOU PAID TO VOWSPACE IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, OR $0 IF YOU ARE A FREE USER.

20. Indemnification

You agree to indemnify, defend, and hold harmless Tropic Endeavors, LLC and its owners, officers, employees, contractors, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or violation of these Terms.

21. Force Majeure

We are not liable for failures or delays caused by events beyond our reasonable control, including outages, natural disasters, cyberattacks, labor disputes, or third-party service failures.

22. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Except where arbitration applies, all disputes shall be brought exclusively in the state or federal courts located in or serving Indian River County, Florida, and you consent to jurisdiction and venue there.

23. Mandatory Arbitration and Class Action Waiver

PLEASE READ CAREFULLY. THIS AFFECTS YOUR LEGAL RIGHTS.

23.1 Informal Resolution

Before arbitration or litigation, you agree to attempt informal resolution by contacting us at [email protected]. We will attempt resolution within 60 days.

23.2 Binding Arbitration

Unresolved disputes shall be resolved by final and binding arbitration administered by JAMS under its applicable rules.

23.3 Class Action Waiver

YOU AND VOWSPACE AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS PART OF ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

23.4 Exceptions

Claims may be brought in small claims court if eligible, or for injunctive relief related to intellectual property or unauthorized access.

23.5 Location

Arbitration may occur by video or phone unless otherwise required.

23.6 30-Day Opt-Out

You may opt out of arbitration within 30 days of first acceptance by emailing [email protected] with subject "ARBITRATION OPT-OUT" and your account email.

24. Time Limit to Bring Claims

Any claim must be brought within one (1) year of accrual or it is permanently barred, to the extent permitted by law.

25. Miscellaneous

  • Severability: Invalid provisions do not affect the rest.
  • No Waiver: Failure to enforce is not a waiver.
  • Assignment: You may not assign these Terms without consent.
  • Entire Agreement: These Terms and referenced policies are the entire agreement.

We strive to make the Service accessible, but we do not guarantee that all features or content will be accessible at all times or compatible with all assistive technologies.
